Terms & Conditions Of Vehicle Hire

1. Definitions
• Company: Primal Cars UK Ltd
• Hirer/Driver: The individual named in this agreement
• Vehicle: The vehicle supplied under this agreement
• Agreement: These Terms & Conditions

2. Rental Payments
2.1 Rental payments must be made weekly in advance.

2.2 Late payments will result in:
• A £10 per day late charge, and/or
• Immediate repossession of the vehicle without notice.

2.3 The Company reserves the right to recover any outstanding payments through debt recovery procedures.

3. Deposit
3.1 A refundable deposit must be paid prior to vehicle handover.

3.2 The deposit will be returned within 14 working days following return of the vehicle, subject to:
• No outstanding balances
• No damage or breach of agreement

3.3 The Company reserves the right to deduct any costs, charges, or liabilities from the deposit.

4. Vehicle Use
4.1 The vehicle may only be driven by the authorised Hirer.

4.2 The vehicle must only be used for:
• Licensed private hire (PCO) purposes
• Lawful activities

4.3 Any misuse of the vehicle may result in immediate termination and repossession.

5. Insurance
5.1 The Hirer must ensure the vehicle is covered by fully comprehensive insurance at all times.

5.2 The Hirer agrees to pay a minimum £1,000 insurance excess per claim (or as per insurer terms).

5.3 Any act or omission by the Hirer that invalidates or prejudices insurance cover will result in the Hirer being fully liable for all losses.

6. Maintenance & Condition
6.1 The Hirer must:
• Check oil, water, and filters weekly
• Maintain the vehicle in good working condition
• Keep the vehicle clean at all times.

6.2 The Hirer is responsible for:
• Tyres, bulbs, filters, and general wear and tear
• Windscreen and glass damage.

6.3 Any faults must be reported immediately.

7. Repairs & Damage
7.1 All damage must be reported immediately.

7.2 The Hirer is responsible for all repair costs unless covered by insurance.

7.3 For rentals exceeding 3 months:
• The Hirer agrees to contribute 50% towards clutch or gearbox replacement

8. Penalty Charges & Fines
8.1 The Hirer is fully responsible for all:
• PCNs, FPNs, congestion charges, ULEZ charges, tolls, and parking charges

8.2 If paid by the Company, the Hirer authorises recovery of:
• The full amount
• Plus an administration fee of £25 per notice

9. Incident Reporting & Claims Notification (Insurance Aligned).

9.1 The Hirer/Driver must notify the Company of any incident as soon as reasonably practicable, and in any event within 24 hours.

9.2 Incidents include (but are not limited to):
• Road traffic accidents (fault or non-fault)
• Vehicle damage
• Theft, attempted theft, fire, or vandalism
• Third-party claims or police involvement.

9.3 The Hirer must provide:
• Full and accurate details
• Third-party information
• Evidence (photos/video where available)
• Police reference (if applicable)

9.4 The Hirer acknowledges that failure to provide prompt notification may prejudice the Company’s ability to notify insurers and manage the claim effectively.

10. Late Notification, Insurance Prejudice & Charges
10.1 Where the Hirer fails to report an incident within the required timeframe:
• The Hirer acknowledges that such delay may prejudice, compromise, or invalidate insurance cover.

10.2 Late Reporting Charges (Cost Recovery Basis)
The following charges apply where late reporting results in increased exposure:
• £500 – reported after 24 hours but within 48 hours
• £1,000 – reported after 48 hours
• £2,500 – not reported and later identified by the Company, insurer, or third party
These charges represent a genuine pre-estimate of loss, including:
• Increased insurance reserves or claim exposure
• Loss of opportunity to investigate
• Administrative and legal costs
• Loss of rental income

10.3 Additional Liability
These charges are in addition to:
• Insurance excess
• Repair and recovery costs
• Storage charges
• Third-party claims
• Legal and administrative expenses

11. Cooperation with Insurers
11.1 The Hirer must fully cooperate with:
• The Company
• Insurance providers
• Legal representatives

11.2 This includes providing statements, evidence, and attending proceedings if required.

11.3 Failure to cooperate may result in full liability for all losses.

12. Uninsured Loss Recovery
Where insurance is invalidated or prejudiced due to the Hirer’s actions:
• All losses become fully recoverable from the Hirer
• This includes third-party liabilities and legal costs
The Company may recover such amounts via:
• Deposit
• Payment methods on file
• Debt recovery procedures

13. Accident & Rental Continuity
13.1 Rental payments must continue during repair or claim periods.

13.2 No courtesy vehicle is guaranteed, particularly in fault claims.

14. Termination
14.1 The Hirer must provide:
• 28 days (4 weeks) written notice

14.2 For contracts under 3 months:
• 2 weeks’ notice required

14.3 Failure to provide notice will result in:
• Loss of deposit

14.4 Early termination charges:
• £500 + £50 admin fee

15. Mileage Policy
15.1 Monthly mileage limit: 3,600 miles

15.2 Excess mileage:
• Charged at £0.25 per mile

16. Breakdown Policy
16.1 The Hirer is responsible for recovery costs.

16.2 The Company will aim to repair the vehicle within 24 hours.

16.3 If delayed:
• A reduced rental rate may be applied at Company discretion

17. Debt Recovery
17.1 Outstanding balances may be referred to external debt recovery agencies.

17.2 The Hirer agrees to cover any associated recovery costs.

18. Company Rights
The Company reserves the right to:
• Repossess the vehicle without notice
• Terminate the agreement immediately
• Retain deposit in case of breach

19. Data Protection
19.1 The Hirer consents to data processing in accordance with the Company’s Privacy Policy.

20. Driver Declaration
The Hirer confirms that:
• All information provided is accurate
• They agree to these Terms & Conditions

21. Governing Law
This agreement is governed by the laws of England and Wales.
